FinCEN Residential Real Estate Reporting Rule
Beginning March 1, 2026, the U.S. Department of the Treasury’s Financial Crimes Enforcement Network (FinCEN) requires title companies, settlement agents, and other real estate professionals to report certain non‑financed residential real estate transfers involving legal entities or trusts. This nationwide rule is designed to increase transparency in real estate and help prevent money laundering and other illicit activity.

If your transaction meets the criteria under the Residential Real Estate Rule, Risingstar Title of Texas is legally required to collect and report specific information about the transferee, transferor, and property. This may include identifying information for beneficial owners when the buyer is an entity or trust. These reports are submitted directly to FinCEN through the federal BSA E‑Filing system.
What Types of Transactions Are Affected
Reporting may be required when:
- The transfer is non‑financed (all‑cash or no qualifying institutional loan).
- The buyer is a legal entity (LLC, corporation, partnership) or a trust.
- The property is residential real estate located in the United States.

What You Can Expect During Your Closing
- Risingstar Title will inform you if your transaction is subject to FinCEN reporting.
- Required identification or ownership information will be requested when applicable.
- Risingstar Title will prepare and submit the report as part of your closing process.
- Your closing will continue as normal—this requirement does not delay or prevent your transaction.
